TikTok 这周末来回折腾，纯粹就是自己给自己加戏。 第一，Biden 宣布了他的政府（任期至 1 月 19 日）不会对 TikTok 的封禁进行执法（enforcement），也就是说政府对于应用商店是否封禁 TikTok 置之不理。应用商店自己想要封禁可以封禁，不封禁理论上违法但也不会受到处罚。 第二，Trump 还不是现任总统，明天（1 月 20 日）他才正式成为总统，此时他根本没有总统权力对 TikTok 做任何事情。Trump 表达的任何关于封禁 TikTok 的观点都无法在今天生效。 第三，TikTok 自己把自己封禁了，禁止美国用户使用。过了半天又说 Trump 怎样怎样，所以自己把自己解封了，美国用户又能使用了。这一切就是 TikTok 自己折腾自己的用户，尝试劫持用户来威胁美国政府。但 TikTok 有没有搞清楚自己该威胁哪任政府？TikTok 明不明白这立法是国会而非政府范畴的事情？我觉得他们自己都不知道。 第四，因为封禁 TikTok 是在国会得到两党支持而通过的法案，Trump 不可能一纸 executive order 就推翻。法案允许总统给封禁延期 90 天，前提是总统向国会证明：TikTok 已经有了可行的分拆计划以及拆分已经有了明显的进展。Biden 没有给 TikTok 延期，延期的机会已经错失，在法律框架下 Trump 是没有给 TikTok 延期的权力的。但这不妨碍 Trump 说他会在 1 月 20 日上任后通过 executive order 给 TikTok 延期。 从历史数据来看，Trump 第一任期签署的 executive order 大部分被法院判定为违法（超越总统权力）而被禁止执行。因此 Trump 可以随口说他准备用 executive order 给 TikTok 延期 90 天，法院是否会禁止他禁止执行禁令则是另外一回事。 90 天延期这事情甚至在共和党内都缺乏共识，Mike Johnson 表示支持对 TikTok 封禁进行执法。没有人知道明天这博弈会如何展开，TikTok 自己也不可能清楚判断。Trump 一发言 TikTok 就激动得自己把自己给解封了，TikTok 真把 Trump 当作美国的独裁者看啦？
