Congress's goal was never to ban TikTok. It was to allow Americans to use the app safe from Chinese Communist Party control. Today, the Supreme Court unanimously upheld that effort while soundly rejecting TikTok's Orwellian position that protecting the First Amendment somehow violates the First Amendment. Had ByteDance spent as much time pursuing a divestment as it had trying to manipulate our political system, the threat of TikTok vanishing on Sunday would not exist. If the app goes dark, ByteDance will have no one to blame but itself. Now, the only obstacles preventing Americans from using TikTok are Xi Jinping and the CCP. The incoming Trump administration has the opportunity to negotiate the deal of a century, force a sale to a non-foreign adversary buyer, and save TikTok for Americans.

This isn’t about banning TikTok. It’s about changing the ownership structure of the app. It would be an act of suicide to allow our foremost adversary to control what is quickly becoming the most dominant news platform in America.

There’s massive amounts of evidence that the CCP has done everything possible to spy on Americans. TikTok is one element of that campaign.

TikTok essentially argued today that a qualified divestment is impossible because the source code and engineering remain in China. That pretty much proves the point: as long as TikTok and ByteDance are beholden to the CCP, the national security threat is too big to ignore.

Congress did not ban TikTok. It simply prevented foreign adversaries from owning our social-media platforms, something we already do for TV and radio stations. SCOTUS must uphold the law and give Americans the chance to use TikTok free from CCP control.
